A suit for declaration and cancellation of Documents is a remedy offered under Section 39
of the Specific Relief Act, 1877,
when there is reasonable apprehension that the property
maybe assigned without any due course of law and the file
is null or voidable and it can cause problematic injury to the affected person.
The damaged person may document a suit to have this document adjudged null or voidable.
The court may in its maturity adjudge this file and order it to be cancelled and declare this document void or voidable.
- Keeping to Section 39 of the Special Relief Act, 1877,
the non-acception may be granted by Court on the following grounds:
- When the written fie in question is can null or voidable as against the plaintiff.
- When the plaintiff may intelligently apprehend serious injury from the document being left outstanding.
